A PALMERS Island prawn farmer who was jailed for three months last August for shooting and killing black cormorants with a 12-gauge shotgun has had his prison sentence overturned.
Immediately after Chung Yan Lee was convicted on two counts of harming protected fauna on August 9 at Maclean Local Court, his solicitor, Mark Spagnolo lodged an appeal against the sentence on Mr Lee's behalf.
The matter was heard on December 12, with the judge presiding in the Land and Environment Court in Sydney allowing the appeal.
When he delivered his judgment last Friday the judge set aside the sentences of imprisonment and fined Lee $7200 for one offence and $5000 for the other.
