Cricket coach who groomed boys for sex has ban lifted

A FORMER cricket coach who groomed young Sunshine Coast players for sex, has had a restriction on him lifted by the Supreme Court.

Dale Martin Burns was convicted of grooming 13- and 14-year-old boys for sex.

They were members of a cricket team he coached between 2002 and 2003.

Burns, 42, who offered his victims cigarettes to procure them, was sentenced to four years in jail.

However, he was released into the community under a strict supervision order in 2008.

Before the Coast offences, Burns had been found guilty of indecently dealing with boys while he was a football coach in 1989.

Burns' supervision order, which included curfews, electronic monitoring and a requirement he not go near a shopping centre, was reviewed in the Supreme Court in Brisbane yesterday.

Justice Peter Applegarth said he was content to remove the provision that Burns not be at a shopping centre between 3pm-6.30pm on school days.

He said it was particularly burdensome for Burns but conceded it was relevant in metropolitan areas where school children would frequent shopping centres.

"However, the respondent's circumstances are such that the requirement imposes unnecessary restraints upon him," Justice Applegarth said.

However, Burns will continue to be electronically monitored in the community at least until 2018.

Justice Applegarth found "some form of monitoring" seemed justified.

He said given the small community Burns lived in, if it was revealed he was subject to the dangerous prisoners' sexual offenders' act, that would have consequences for his ability to remain in the community.

Burns' legal team and counsel for the Attorney-General agreed on a draft order which meant he would still submit to drug testing and electronic monitoring.
