A MACKAY mother has had to face the harsh reality of her ongoing drug offending after she was ordered to spend the next two months behind bars.

Kristy Rae Crutcher broke down when she found out she had used up all her chances.

In fact the mother of two was on an intensive correction order - which is a jail term allowing an offender to stay in the community - when she was busted, twice, with methylamphetamines.

"The court is here to help you rehabilitate… but at the end of the day the court is also here to punish you," Magistrate Bronwyn Hartigan told the 29 year old.

"I think it's important for you to understand that this situation is of your own making and the consequences that flow from here are of your own making."

Mackay Magistrates Court heard Crutcher had 16 convictions on her criminal history for drug offending.

On Friday, she pleaded guilty to possessing small amounts of ice, ecstasy and marijuana and utensils in August last year, 20 days after a parole order ended, and possessing 0.414 grams of ice in October when she was on bail for the earlier charges.

Ms Hartigan said her offending was all the more serious because she had breached the intensive corrections order.

"In reality it is a last resort. It is a privilege that you're given by the court to just change your ways before you have to actually go into custody," she said.

"You had that chance, you had many chances."

The court heard in isolation, none of the charges were particularly serious and under normal circumstances jail was a last resort.

Solicitor Natalie Simonsen, of Barron and Allen Lawyers, had pushed for a wholly suspended sentence arguing Crutcher was the full-time carer of her children and had work lined up.

Ms Simonsen also spoke of a traumatic time in her client's life and that she later used drugs as a crutch.

However Ms Hartigan told Crutcher she had to be sentenced on the full picture.

"What I give you today has to reflect that otherwise it makes a mockery of the criminal justice system," she said.

"It's true to say that imprisonment is a last resort because you're not facing any offences of violence and keeping you in the community is preferable.

"But sometimes those considerations have to give way to punishment and reflecting the overall criminality of what you've done and the circumstances of which those offences were committed.

"You had jail, you were just allowed to serve it at home."

Crutcher was jailed for six months, to be suspended after serving two months, with the remainder hanging over her head for the next two years.

"It pains me for the fallout of your children, who need you, but at the end of the day in accordance with the oath that I took I cannot leave you in the community."
