Toowoomba peeping tom assaults massage client

A TOOWOOMBA psychologist has not been able to curb a nail salon owner's compulsion to peep at women in toilet cubicles, with the behaviour escalating to sexual assault on a massage client.

Duy Hung Tran, 38, was jailed for six months last year for using his phone camera to try to film a 21-year-old woman using the facilities at the Southern Hotel in Toowoomba.

He has previously spied on two other girls, aged 14 and 18, in separate incidents, also in public toilets.

Despite seeking counselling to address the issue, Tran is now being sentenced in Brisbane District Court for sexually assaulting an 18-year-old massage client at his salon in February.

Crown prosecutor Belinda Merrin said on Wednesday that Tran rubbed the girls breasts and genitals under her clothing during the massage and would not let her leave when she protested.

She said he used his mouth on the woman's breasts, which was later used to source DNA to prove the subsequent complaint.

Ms Merrin said Mr Tran had breached probation and parole orders, asking the court to jail him for 18 months to two years with parole eligibility, not assured parole release.

"He represents a high risk of offending and is an unlikely candidate for rehabilitation," she said.

Defence barrister Scott Lynch said his married client had been travelling to Toowoomba regularly for psychological treatment because he recognised he had a problem.

He said Tran was in a destructive relationship where his wife controlled everything and threatened to have him deported if he did not follow her instructions.

Mr Lynch said Tran had gender and sexually issues related to being called a little girl as a child that could be connected to his behaviour in female toilets.

Judge Milton Griffin said Tran's attempts to seek treatment demonstrated, despite the counselling failings which were "shocking and appalling for the victims", he wanted to deal with the issues.

He said he needed more time to decide whether to follow the prosecution's sentence suggestion or whether a combined custody and probation order would aid rehabilitation.

Judge Griffin will deliver his sentence at 9.45am on Thursday.
